Terms of Service

1. The service

SafeShell provides software that helps users organize workplace information and turn it into tasks and actions. Features may include local software, cloud-connected functions, integrations with third-party services, and preview or beta functionality.

2. Eligibility and accounts

You must be legally able to enter into these terms and use SafeShell for professional or organizational purposes. You are responsible for the accuracy of information you provide, for protecting your devices and credentials, and for activity performed through your account or authorized connections. Notify us promptly if you suspect unauthorized access.

3. License and permitted use

Subject to these terms, SafeShell grants you a limited, non-exclusive, non-transferable, revocable right to install and use the service for its intended purpose during the period it is made available to you. No ownership rights are transferred.

4. Acceptable use

You must comply with applicable law and must not:

• Use SafeShell to violate another person's rights, confidentiality, privacy, or intellectual property.
• Upload or process content you are not authorized to use.
• Introduce malware, bypass security controls, probe vulnerabilities without written authorization, or disrupt the service.
• Use the service for unlawful surveillance, discrimination, harassment, fraud, or other harmful activity.
• Reverse engineer, resell, sublicense, or commercially exploit SafeShell except where applicable law or a written agreement expressly permits it.
• Use automated means in a manner that creates unreasonable load or interferes with other users.

5. Your content and responsibilities

You retain your rights in content you provide or connect to SafeShell. You grant SafeShell only the rights needed to process that content to provide, secure, maintain, and support the service. You are responsible for having all necessary permissions, notices, and lawful bases for the content and personal data you process, including workplace and third-party data.

6. Microsoft and other third-party services

Integrations operate only after you or your organization authorizes the requested permissions. Your use of Microsoft and other third-party services remains governed by their respective terms and policies. SafeShell is not responsible for third-party availability, changes, suspension, data practices, or actions. You may disconnect an integration through the applicable account or organization settings.

7. Privacy and security

Our Privacy Statement explains how personal data is handled. You are responsible for configuring SafeShell appropriately for your environment, limiting permissions, maintaining backups where needed, and reviewing generated actions before relying on them. SafeShell does not replace professional, legal, security, compliance, or business judgment.

8. Availability, beta features, and changes

SafeShell may be modified, updated, suspended, or discontinued. Preview and beta features may be incomplete, contain errors, change without notice, or be unsuitable for production use. We may provide updates for security, compatibility, or functionality, and continued use may require installing them.

9. Fees and commercial agreements

Any paid plan, professional service, support commitment, service level, or commercial license is subject to the order, quotation, or separate written agreement accepted by the parties. If those documents conflict with these terms, the separately signed commercial agreement controls for that subject.

10. Intellectual property and feedback

SafeShell, its software, branding, documentation, and service components are protected by intellectual-property laws and remain the property of their respective owners. If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

11. Suspension and termination

You may stop using SafeShell and disconnect integrations at any time. We may restrict or suspend access when reasonably necessary to address a security risk, unlawful use, material breach, non-payment under a paid agreement, or harm to SafeShell, users, or third parties. Provisions that by their nature should survive termination remain effective.

12. Disclaimers

To the maximum extent permitted by law, SafeShell is provided on an “as is” and “as available” basis. We do not warrant that the service will always be uninterrupted, error-free, secure, or suitable for every purpose, or that generated suggestions and actions will be complete or accurate. Rights and warranties that cannot legally be excluded remain unaffected.

13. Limitation of liability

To the maximum extent permitted by law, SafeShell and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunity arising from the service. Any aggregate liability will not exceed the amount paid for the service during the twelve months preceding the event giving rise to the claim, or EUR 100 if no amount was paid. This limitation does not apply where liability cannot lawfully be limited.

14. Changes, law, and disputes

We may update these terms and will publish the revised version with a new effective date. Material changes will be communicated when reasonably possible. Mandatory consumer and data-protection rights remain unaffected. Any governing-law or dispute terms in a separately signed commercial agreement take precedence; otherwise, the applicable law and competent courts are determined under mandatory conflict-of-law and jurisdiction rules.
